TERMS OF SERVICE

Welcome to GoFish. These Terms of Service ("Terms") govern your access to and use of the GoFish platform, including our website at gofishvip.com, mobile applications, booking widget, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

2. DESCRIPTION OF SERVICE

GoFish provides a charter fishing booking and operations management platform that includes:

• Online booking and reservation management
• Embeddable booking widget for charter operator websites
• Client communication tools (email, SMS)
• Fleet and boat management
• Crew scheduling and assignment
• Payment processing (via Stripe)
• Mobile applications for iOS and Android
• Gift certificate sales and redemption
• Two-way calendar sync with Google Calendar
• Digital waiver collection
• QR code check-in
• Upsells and add-on sales during booking
• Point of sale for walk-up bookings

3. ACCOUNT REGISTRATION

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and not share your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. PRICING AND FEES

GoFish is free for charter operators. There are no monthly subscription fees or per-booking commissions charged to operators. A small convenience fee may be applied to anglers (clients) at the time of booking. Payment processing fees charged by Stripe are separate and subject to Stripe's terms.

We reserve the right to modify our pricing model at any time. We will provide at least 30 days' notice before any pricing changes that affect your account.

5. USER RESPONSIBILITIES

When using the Service, you agree to:

• Comply with all applicable local, state, and federal laws and regulations
• Maintain all necessary licenses and permits for your charter fishing operation
• Provide accurate information about your trips, pricing, and availability
• Honor bookings made through the platform in accordance with your stated policies
• Not use the Service for any unlawful or fraudulent purpose
• Not attempt to reverse engineer, decompile, or disassemble the Service
• Not interfere with the security or integrity of the Service

6. BOOKINGS, CANCELLATIONS, AND REFUNDS

Charter operators are responsible for setting and managing their own cancellation and refund policies. GoFish facilitates communication and payment processing but is not a party to the contractual agreement between operators and their clients.

Disputes between operators and clients regarding bookings, cancellations, or refunds should be resolved directly between the parties. GoFish may, at its discretion, provide mediation support but is not obligated to do so.

7. INTELLECTUAL PROPERTY

The Service, including its original content, features, and functionality, is owned by GoFish and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or branding without prior written consent.

You retain ownership of all content you submit to the Service (business data, photos, descriptions, etc.). By submitting content, you grant GoFish a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of providing the Service.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, GoFish and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

GoFish does not guarantee that the Service will be available at all times or free from errors. We are not responsible for the actions, content, or conduct of charter operators or their clients.

9. DISCLAIMER OF WARRANTIES

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. GoFish does not warrant that the Service will meet your specific requirements or that it will be uninterrupted, timely, secure, or error-free.

10. TERMINATION

You may terminate your account at any time by contacting us or using the account settings within the Service. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Upon termination, your right to use the Service will cease immediately. We may retain certain information as required by law or for legitimate business purposes.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in the State of Florida.

12. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
